This Privacy Notice governs the processing of Your personal data by Frequentis AG, Innovationsstrasse 1, 1100 Vienna, Austria and its majority owned subsidiaries (together “Frequentis”, “We”, "Us" “Our”) on the following websites:

and on their respective subsites (together “Frequentis Websites"), as well as personal data generated by means of using other forms of communication with You, unless an existing contractual relationship with You already provides You with the requisite information.
We also inform You about Your data subject rights, and how You may control collection and processing of Your personal data.
1 Contacting us without using Frequentis Websites
1.1 Via E-Mail, Phone, Instant Messaging, Hardcopy Letters
If You contact Us by other means of communication than via the Frequentis Websites for example by phone, email, instant messaging or by sending Us a hardcopy letter or when You give your business card to one of Our employees , We will process at least Your name, contact data and the fact that You have contacted Us and when You did so electronically, by entering it in a database which is appropriate for handling your enquiry.
If necessary for understanding or resolving Your request, We will process any other personal data You have voluntarily provided Us with during Your request, based on Your consent and the purpose defined by You (Art. 6 (1) a GDPR). If You contact Us in relation to a new or existing contract, We will conduct the processing based on our legitimate interests with regards to an optimal customer service, preparation of offers and performance of the contracts based on Art. 6 (1) f. If in the forementioned case, You are the direct contractor in person the legal ground is Art. 6 (1) b GDPR.
For IT security reason, We will also log certain information (e.g. IP Address) that will be retrieved if necessary to investigate an IT incident. This processing is thus based on our legitimate interest (Art. 6 (1) f GDPR) consisting of the maintenance of system, ensuring that a reliable connection to the website is established, ensuring comfortable use of our website and evaluation of the system security and stability of the system.
We might also contact You and ask You if You want to receive our newsletter regarding the products you were interested in originally. This processing is done based on Our legitimate interest (Art. 6 (1) f GDPR) to collect Your consent for our newsletter.

1.1.1 Data Transfers and Data Processors
Your personal data will be transferred within Our departments as far as this is necessary to process Your personal data for the purpose of Your request. In general, transfer is made on the basis of our legitimate interest (Art. 6 (1) lit f GDPR) where this is required to fulfil Your request or Our contractual obligations in line with Our internal processes and procedures. Where Frequentis subsidiaries act as data processors or joint controllers, We concluded data processing agreements in accordance with Art. 26 and Art. 28 GDPR and transfer data only to those companies who ensure adequate safeguards to protect Your personal data.
For processing Your request, We use MS365 (e.g. Outlook, Teams etc.) services provided by Microsoft as Our data processor. For further information please refer to Chapter 5. To process Your personal data for Our newsletters and marketing campaigns We use Oracle Austria GmbH as our sub-processor. For further information please refer to Chapter 2.2.2. For hosting Our website, We use Internex GmbH as Our webhosting provider.
1.2 Publicly available areas of Frequentis Websites
You can use the publicly accessible areas of Our Frequentis Websites without disclosing Your identity. Please also refer to section 2 “Cookies and Tracking” and section 3 “Plugins" to avoid disclosing Your identity by activating Cookies, Tracking scripts or Plugins. In case We explicitly ask You for personal data (e.g. name, e-mail address, relevant region/market), for example when You use the contact form or register for a newsletter, You do so voluntarily. We only use the information provided by You for the purpose You provided Us the information for, such as sending You the requested material. Before We track Your activities on Frequentis Websites - with the help of cookies and/or tracking scripts - We ask for Your confirmation in Our cookie banner (for further details, see the section 2 “Cookies and Tracking”). You can also use the “Private” mode of Your browser or delete cookies via Your browser to avoid tracking.
If You communicate with Us by using a contact form on Frequentis Websites, the information marked as “required” is necessary for Us to efficiently handle Your enquiry. 1.3 Areas requiring a login
1.3.1 Subsites available to customers
Several areas of Our website are available to customers only and require dedicated login credentials, such as the areas where a customer can submit various support tickets.
Any personal data exchanged between You or Your organisation and Us in such areas is governed by the contract between Us and Your organisation and the data protection provisions of that contract. We process such data based on Art. 6 (1) f or Art. 28 GDPR including the terms of the data processing agreement between Your organisation and Frequentis as the case may be. Our legitimate interests is the optimal customer service, preparation of offers and performance of the contracts. If in the forementioned case, You are the direct contractor in person the legal ground is Art. 6 (1) b or Art. 28 GDPR including the terms of the data processing agreement between Your organisation and Frequentis as the case may be.
Processing includes all personal data that is included by You in the process (e.g. by uploading log files containing personal data). In case You are required to self-register for a customer service in order to use it, the personal data You might have entered (e.g. name or login ID, contact data, Your organisation) and which is marked as required by Us is necessary to link Your account to the relevant customer contract and perform authorisation checks, and will only be used by Us for that purpose. We will delete Your personal data as agreed on in the contract concluded between Your organisation and Frequentis or after the purpose, for which Your personal data was collected, was achieved.
Your personal data will be transferred within Our departments as far as this is necessary to process Your personal data for the purpose of Your request. When we do not act as Your data processor, transfer is made on the basis of our legitimate interest (Art. 6 (1) lit f GDPR) where this is required to fulfil Your request or Our contractual obligations in line with Our internal processes and procedures. Where Frequentis subsidiaries act as data processors or joint controllers, we concluded data processing agreements in accordance with Art. 26 and Art. 28 GDPR and transfer data only to those companies who ensure adequate safeguards to protect Your personal data.
For processing Your data, We use MS365 services (e.g. Outlook, Teams, Sharepoint online etc.) provided by Microsoft as Our data processor. For further information please refer to Chapter 5.
1.3.2 Job applicants – jobs.frequentis.com
You can read Our job offerings without having to disclose Your identity. To apply for an offering or to express Your general interest in working for Frequentis, You first need to register at our Job-Portal (jobs.frequentis.com) by entering your name and e-mail address. This information is used to administer Your account on a technical level. The processing is based on Art. 6 (1) lit b GDPR where this is necessary to evaluate a potential contractual relationship and Art. 6 (1) lit a GDPR where You have consent to the processing.
For personal data provided by You for applications We use Avature GmbH as our data processor for hosting the application platform at jobs.frequentis.com. Processing of Your personal data in the application process is explained in the privacy notice accessible at jobs.frequentis.com in more detail.
2 Cookies and Tracking
We use so-called “cookies” on Our Frequentis Websites. Cookies are small text files stored on Your electronic end-device. They contain certain personal information (e.g. Your IP-Address). We also use tracking scripts (e.g. LinkedIn Insight Tag) which are a piece of code that is used to monitor visitors that arrive at a Frequentis Website via a Frequentis marketing campaign. Cookies and tracking scripts enable Us to analyse how Frequentis Websites are used and allow Us to see when You visit Frequentis Websites again. You can use the “in private” or “incognito” mode of Your browser or configure Your browser in such a way that Frequentis Websites can no longer store cookies or run tracking scripts on Your computer (if You do so, You also would have to delete the already existing ones). You can choose Cookies and tracking scripts Yourself via the Cookie Banner when You first visit Frequentis Websites by pressing the “Accept All” or “Reject All” Button. The processing of Your personal data using such Cookies and Tracking scripts is based on Your consent (Art. 6 (1) a GDPR). Personal data We collect using Cookies and Tracking scripts is further processed to analyse in which products You might be interested in or how You interacted with Frequentis Websites. Such processing is based on Your consent (Art. 6 (1) a GDPR) and on Our legitimate interest under Art. 6 (1) f GDPR. Certain cookies or third-party services are “functional” and will be stored or executed for IT security reasons and to ensure the proper functioning of Frequentis Websites. Such cookies and tracking scripts can be found in the section “functional” of the cookie banner. Personal data processed this way is done on our legitimate interest (Art. 6 (1) f GDPR).

2.2.1 Google Tag Manager and Google Analytics 4
Frequentis Websites use Google Tag Manager and Google Analytics 4, a web analysis service from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). It uses so-called cookies, text files that are stored on Your end-device (e.g. computer, smartphone) and allow Us to analyse how You use Frequentis Websites. The information contained in these cookies is transferred and stored on a Google server in the European Union. It cannot be ruled out in any case that, while performing support and administrative services as part of their contractual obligation, employees of Google outside the EU might have access to user data. Thus, we have ensured that Google reaches an adequate level of data protection by providing for appropriate safeguards under the GDPR.
Google will use this information to evaluate how people use Frequentis Websites, prepare reports of website activities for Us and deliver other services connected with the use of Frequentis Websites. Additionally, Google may transfer this information to third parties if it is legally required or if third parties process these data on request of Google.

2.2.2 Oracle Eloqua
We use Oracle’s Eloqua on Frequentis Websites and for Our email services and newsletters. Unless a Cookie is already stored on Your device, Eloqua will store a Cookie to provide for a better user experience, tracking and analysis. E-Mails sent with Eloqua use tracking technologies. We use this data primarily to find out in which topics You are interested in by tracking whether You have opened a marketing e-mail we sent or not and which links You have clicked within the E-Mail. We then use this information to personalize the emails We send You, to improve Our services and to connect this information with existing tracking or profiling information.
It cannot be ruled out in any case that, while performing support and administrative services as part of their contractual obligation, employees of Oracle Corporation outside the EU might have access to user data. We use LinkedIn Ads for our marketing campaigns. Your personal data (IP-Address, User ID) will be transferred to LinkedIn to allow Us to evaluate the success of our marketing campaign.
2.2.3.2 LinkedIn Insight Tag
We are executing a script on Frequentis Websites that helps Us to evaluate the success of Our advertisement campaigns on LinkedIn. In case You reached Our Frequentis Websites by clicking one of Our LinkedIn-Ads on the LinkedIn Website and additionally enabled Cookies on Our website, this script will tell Us that you reached our site by clicking our LinkedIn-Ad on the LinkedIn Website. You can avoid this by disabling the cookies with the “Reject All” Button upon Your first visit of our Website or at all times in the “Manage Cookies” section.

3 Plugins and other external services
We use external services in order to provide You with certain multimedia content (e.g. videos, pictures and locations). To do so, We need to transfer Your IP-address to the third party mentioned below to deliver the necessary information to Your end-device. Such processing is done on the basis of Your consent (Art 6(1) a GDPR), where data has to be stored on Your end-device or Our legitimate interest (Art 6(1) lit f GDPR) were storage of data on Your end-device is not necessary. Consent can be given and withdrawn via “Manage Cookies”.
The below mentioned provider might access Your personal data from a country outside the European Union. In this case, We have ensured additional safeguard to protect Your personal data in an adequate way. For countries that do not have an adequacy decision, We signed the EU standard contractual clauses, in order to ensure an adequate protection of Your personal data.

To easily show You how You can find Our offices and in which countries We have customers and references, We have integrated Google Maps into Frequentis Websites.
By visiting a page on Frequentis Websites which feature a Google map, a connection to a Google server is made, and in this process the data made available by Your browser, such as Your full IP address, is collected and processed by Google. Your IP-address is used to provide You with the content and is not stored by Us for this purpose. We base the processing on Art 6(1) lit f GDPR to ensure the correct functioning of the plugin.
3.1.2 Google Photos
By visiting a page on Frequentis Websites which feature Google Photos, a connection to a Google server is made, and in this process the data made available by Your browser, such as Your full IP address, is collected and processed by Google. Your IP-address is used to provide You with the content and is not stored by Us for this purpose. We base the processing on Art 6(1) lit f GDPR to ensure the correct functioning of the plugin.
3.1.3 Google reCAPTCHA
By visiting a page on Frequentis Websites which features Google’s reCAPTCHA, a connection to a Google server is made, and in this process the data made available by Your browser, such as Your full IP address, is collected and processed by Google. Your IP-address is used to provide to verify that You are human and do not intend to endanger the functioning of Frequentis Websites. Hence, We base the processing on Art 6(1) lit f GPDR.

We process this data to analyse the use of Frequentis Websites, thus on Art 6(1) lit f GDPR.

3.3 Cloudflare
Frequentis Websites use services provided by Cloudflare, Inc. Cloudflare is a web-infrastructure and website-security company, providing content-delivery-network services, DDoS mitigation, Internet security, and distributed domain-name-server services. Cloudflare’s services sit between a website’s visitor and the Cloudflare user’s hosting provider, acting as a reverse proxy for websites. Cloudflare may collect certain information about Your use of Frequentis Websites and process data, which includes >our IP address and other information about traffic to and from Frequentis Websites. This data is used for the operation of Frequentis Websites and thus based on Art 6(1) f GDPR. Cloudflare uses cookies on Frequentis Websites for security and network management reasons. For example, Cloudflare uses a cookie named “__cfduid” to identify individual clients behind a shared IP address and apply security settings on a per-client basis. See chapter 2.1.
3.4 New Relic
Our website uses New Relic, a web application performance service provided by New Relic Inc. New Relic provides statistical data on how Our website is used and measures the performance of Our website. New Relic collects data related to the system data of the device You use to access Our website, such as browser type and version, time zone, operating system, and platform. It also collects usage data, which includes the date and time of each visitor request, and the starting/exit pages. New Relic uses this information to monitor the functionality of Our website, to record data about website traffic and interactions, and to identify any technical issues on Our website. We process this data to analyse the use of Frequentis Websites, thus on Art 6(1) lit f GDPR.
3.5 Euroland
To provide You with information on Our stock, We embedded the euroland.com stock information. For this a connection is made to euroland.com, which will process certain data of You (IP-Address or browser used) to provide You with the information. In order to provide You with the information We process Your IP-Address on the basis of Art 6(1) lit f to provide You with company related information to Our stock.
3.6 3Dvista
We use 3Dvista on certain subsites to provide You with multimedia content. To allow the delivery of the data to Your end-device, We need to at least disclose Your IP-Address to 3Dvista. For the 3Dvista privacy policy please refer to https://www.3dvista.com/en/privacy_policy/.
In order to provide You with the information We process Your IP-Address on the basis of Art 6(1) lit f so that the multimedia content is correctly displayed.
4 Share buttons
4.1 LinkedIn (share button)
Pages in the “News” and “Press Releases” sections of Frequentis Websites have a LinkedIn share button.
No information is transmitted to LinkedIn by Our website unless You click on the icon. Clicking on the icon takes You away from Our website and directly to LinkedIn. By this operation, LinkedIn will learn Your full IP address, the page on Our website the LinkedIn icon was located on and, depending on Your browser settings, Your browsing history.

5 Microsoft 365
5.1 Purpose of the processing
We process Your personal data necessary to conduct and manage Our internal organisation and communication with You. For this We use Microsoft 365 services including, among others, MS Teams, MS CoPilot, SharePoint Online, Outlook and OneDrive. Specifically, We process Your personal data for the following purposes:
- Receiving E-Mails, including any attachments, from You, processing them (including storage and routine backup and archiving) and sending E-Mails to You,
- Processing necessary contact information (e.g. Name and E-Mail address) within Microsoft 365 services as well as in Our Customer Relationship Management System (CRM),
- Processing the personal data in any content of Your E-Mail (including storage, routine backup and archiving),
- Processing personal data in any files and any content of the files You send, upload or otherwise share with Us through Microsoft 365 services,
- Interacting via chat, video-chat or voice-chat or other means of messaging including the processing of personal data of any files You uploaded or otherwise shared with Us using the Microsoft 365 services,
- to set up and commence virtual meetings and teleconferences via the provided Microsoft 365 services,
- Processing for collaboration activities and project management tasks using the Microsoft 365 services (especially Sharepoint online and OneDrive).
- Processing personal data while logging and investigating IT-incidents,
- Archiving personal data for business continuity purposes.
5.2 Categories of data processed
Depending on Your interaction with Us using Microsoft 365 services We process personal data including personal data in any text-files, audio, video, or image files, and software, that are provided by You to Frequentis using the Microsoft 365 services.
This may include
- Professional contact information, work, and organization data (e.g. name, email, company, employee ID number, photos, and so on);
- Personal phone numbers and private data derived from user content;
- First name, last name;
- Photo, video and audio transmission;
- Email address;
- Email content, including attachments;
- Administrative events (e.g. access to a Team, creation of a channel, sending of an email, and so on);
- Meta data relating to inter alia calls and meetings (e.g. network status, date, time, duration, end device used, data on audio quality);
- User activities (chat messages, file access) of externals without user ID;
- Live transmission of audio and video and screen;
- Recording of video and audio, and sometimes also screen;
- Cookies are processed for relevant applications, in particular for web applications. This is to ensure the operation and security of the applications;
- Communication data (IP-Address, connection time and duration).
5.3 Legal basis for the processing and storage period
The legal basis for the processing of Your personal data processed with Microsoft 365 services is Art 6(1) a GDPR for personal data that We process to fulfil any requests You sent via Microsoft 365 services that are not related to a contractual relationship.
We process personal data with Microsoft 365 services based on Art 6(1) b GDPR where this is necessary to fulfil the (pre)contractual relationship with You.
We process personal data with Microsoft 365 services based on Art 6(1) c GDPR where this is necessary to comply with any mandatory laws (e.g. legal requirements for data retention).
We process personal data with Microsoft 365 services based on Art 6(1) f GDPR where this is in Our legitimate interest to do so, especially to ensure a proper functioning of Our organisation and, as far as permitted by data protection laws, for marketing purposes (e.g. to ask for Your consent to receive newsletters regarding Our products).
We store Your data for as long as it is required to fulfil the purpose We collected the data for or for as long as We maintain a legitimate interest and/or legal basis to do so. We also process Your data during routine backups to ensure compliance with business continuity requirements. Access to any backup-ed data is strictly restricted via company policies.
5.4 Data Transfer
Your personal data will be transferred within Our departments and subsidiaries as far as this is necessary to process Your personal data for the purpose of Your request. In general, transfer is made on the basis of Our legitimate interest (Art 6(1) lit f GDPR) where this is required to fulfil Your request or Our contractual obligations in line with Our internal processes and procedures. Your personal data is processed by Microsoft as Our data processor in accordance with Art 28 GDPR. Your personal data is stored on Our cloud tenant within the EU. It cannot be ruled out in any case that, while performing support and administrative services as part of their contractual obligation, employees of Microsoft outside the EU might have access to user data. Thus, We have ensured that Microsoft reaches an adequate level of data protection by providing for appropriate safeguards under the GDPR. 6 Webinar, Voice- and Video Conferences
6.1 Webinar
For Webinars We use the platform GoTo Webinar.
We use GoTo Technologies Ireland Unlimited Company (“GoTo”) as Our processor for the processing of Your personal data. We have concluded a data processing agreement and the EU Standard Contractual Clauses with GoTo to ensure an adequate level of protection of Your data. For further information regarding the processing of Your data see the GoTo International Privacy Policy.
If You sign up for one of Our webinars We will process Your full name, e-mail-address, company name and company address (optional) to send You a link to the webinar You signed up for. If You provide Us with information of any special interest in certain activities, events or products of Frequentis (optional), We will process this information to send You newsletters or other information (but always limited to marketing purposes) related to the information You gave Us. This will be done through the tool Oracle Eloqua – see 2.2.2 of this Privacy Notice. We will ask for you consent to receive such newsletters in a separate E-Mail (see 1.1 of the Privacy Notice).
The legal basis for this processing is Your consent (Art. 6 (1) a GDPR). We might also process certain data on the legal basis of a legitimate interest (Art. 6 (1) f GDPR).
You can withdraw Your consent at any time with effect for the future. We will delete Your personal data after You have withdrawn Your consent for processing the data or requested the deletion of Your data.

6.2 Microsoft Teams
For Voice- and Video Conferences We use Microsoft Teams.
Personal data processed are Your audio (voice), video and any personal data You share in the chat for the conference. If a conference is recorded, We are asking for Your explicit consent before You can unmute Your microphone or activate Your camera.
If You join a conference using Microsoft Teams Your personal data will be processed based on Your consent under Art. 6 (1) a GDPR. We process such data also based on Art. 6 (1) f or Art. 28 GDPR including the terms of the data processing agreement between Your organisation and Frequentis as the case may be. Our legitimate interests is the optimal customer service, preparation of offers and performance of the contracts. If in the forementioned case, You are the direct contractor in person the legal ground is Art. 6 (1) b or Art. 28 GDPR including the terms of the data processing agreement between Your organisation and Frequentis as the case may be.
Conferences can be recorded (video, voice and chat), and this recording might be used for further processing under the legal basis above or for Our legitimate basis under Art. 6 (1) f GDPR or might as well be necessary to be processed for reasons under Art. 6 (1) c GDPR especially where this is necessary to comply with any mandatory laws.
Within Microsoft Teams We use recognition functions (voice and face). This helps to suppress background noises in Teams through voice isolation and to recognise and display >our Name during meetings. To use this function, You have to create a voice and/or face profile which can be managed (created, modified and deleted) by yourself. We cannot and do not access Your voice and/or face profile.

We store Your data for as long as it’s required to fulfil the purpose, We collected the data for, or for as long as We maintain a legitimate interest and/or legal basis to do so. Recordings will be automatically deleted after an individually set period, depending on the purpose for which conference was recorded.
7 Proxyclick
Proxyclick, provided by Eptura, is used for Our visitor management. When invited to the premises to the Viennese Frequentis Headquarter, Innovationsstraße 1, 1100 Vienna, Austria, You will receive instructions on how to register for the visit.
7.1 Data Processing
Personal Data (surname, given name, company name, mail address, ID data, copy of ID documents) are collected and processed for the visitor management and are stored and archived to fulfil the requirements of and to maintain the facility clearance.
We collect and process personal data based on a legitimate interest (Art. 6 (1) f) to ensure that only authorized persons are allowed within the Frequentis AG facilities. The storage of the data after the visit is thus based on a legitimate interest and, where it is necessary for the facility clearance of Frequentis AG, based on a legal obligation (Art. 6 (1) c, Art. 6 (1) f).
7.2 Data transfer / Data recipients
Proxyclick stores the data in locations within the European Union. Where it cannot be ruled out that access is needed from outside the European Union (e.g. for support tasks) and the processing cannot be based on an adequacy decision, Frequentis has concluded the appropriate agreements to ensure sufficient safeguards for Our personal data.
Your personal data is also transferred internally to Our CRM, in order to provide You with the necessary information for Your registration as well as this information on data processing.
7.3 Data retention and deletion
Your data is being stored within Proxyclick for a period of 1 (one) year, thereafter it is deleted. We are obliged to save a copy of the data and store it within the Frequentis AG premises to fulfil the requirements to maintain facility clearance. This copy is stored for 10 (ten) years and will only be accessed to fulfil obligations in connection with Our facility clearance.
Access to the stored data is restricted to people who have a need-to know.
8 Hosting Frequentis Websites and Logging
8.1 Hosting Frequentis Websites
Our website is hosted by a third-party service provider Internex GmbH acting as Our data processor (Art 28 GDPR). This hosting service provider supplies the necessary technology and services required for Our website to be accessible on the internet. Our hosting provider may have access to certain personal data that passes through their servers, but they are not allowed to use such information for any purpose other than providing hosting services.
8.2 Server Log Files
When You visit Our website, Our servers automatically log standard access information including IP-Address, browser type, access times, URL requested, and referral URL. This information is not shared with third parties and is used only within Our organisation on a need-to-know basis (e.g. in case of an incident of interruptions of Our service). Any individually identifiable information related to this data will not be used in any way different from that stated above without Your explicit permission. This processing is done based on Our legitimate interest (Art 6(1) f GDPR) to ensure a safe, secure and reliable operation of Frequentis Websites.
9 Your data subject rights
We hereby inform You that pursuant to Art.15 et seq. GDPR You have the right to obtain information on the personal data concerning You, as well as rectification or deletion or limitation of processing or of a right to object to processing as well as of the personal data right to have data portability.
Likewise, under Art. 77 of the GDPR, You have the right to complain to a data protection supervisory authority if You consider that the processing of Your personal data in breach of the GDPR.
If the processing is based on Art. 6 (1) a GDPR or Art. 9 (2) a GDPR (consent), You also have the right to revoke the consent at any time without affecting the legality of the processing based on the consent until the revocation. As a user of Our website, You have this right when You have registered for a newsletter or as a job applicant, for example.
10 Change of our data protection policies and statements
We reserve the right to amend this Privacy Policy from time to time so that it will always comply with legal requirements or when We change Our services.
